    Donald Trump is scheduled to appear in court today to be formally arraigned on charges of conspiring to overturn the 2020 presidential election, in what marks his third – and potentially most serious – criminal case.

    The former president was indicted on four charges by a grand jury hearing evidence in special counsel Jack Smith’s investigation in efforts to overturn the 2020 election and the January 6 Capitol riot. The indictment also described six unnamed co-conspirators, now believed to be identified.

    Mr Trump has been ordered to make an initial appearance in federal court in Washington DC on Thursday, while the case has been assigned to US district judge Tanya Chutkan, a Barack Obama-appointee.

    Mr Trump has railed against the indictment and is calling for the “fake” case to be moved from Washington DC.

    In a late-night Truth Social rant on Wednesday, the former president fumed that it is “IMPOSSIBLE to get a fair trial” in the capital and demanded it be relocated to “the politically unbiased nearby State of West Virginia”.

    This is Mr Trump’s third criminal indictment and his second federal indictment.

    “The latest Fake “case” brought by Crooked Joe Biden & Deranged Jack Smith will hopefully be moved to an impartial Venue, such as the politically unbiased nearby State of West Virginia!” he wrote.

    “IMPOSSIBLE to get a fair trial in Washington, D.C., which is over 95% anti-Trump, & for which I have called for a Federal TAKEOVER in order to bring our Capital back to Greatness.

    Analysis: Latest Trump indictment is stress test of Biden’s focus on safeguarding democracy

    After two previous indictments, the novelty of prosecuting a former president may have worn off. But the latest criminal charges against Donald Trump represent an unprecedented stress test for the American political system.

    Trump is accused of conspiracy and obstruction for trying to overturn his 2020 election loss, in a criminal case emerging at the same time he is asking voters to send him back to the White House.

    The overlapping legal and political dramas represent a stark challenge for President Joe Biden just as he is running for reelection in 2024. Although Biden has made protecting democracy a cornerstone of his agenda and campaign, he also has pledged to respect the independence of the judicial process.

    The result is that Biden probably will feel compelled to remain quiet about a court case that could send the leading Republican presidential candidate to prison, even though the charges hinge on behaviour that Biden has described as an existential threat.

    Former Vice President Mike Pence’s testimony and handwritten notes describing private interactions with former president Donald Trump appear to have played a key role in securing charges against the twice-impeached, thrice-indicted ex-president for crimes allegedly committed while attempting to overturn the 2020 presidential election results.
