A Vancouver used car lot is suing a man who sold it two high-end vehicles for $103,000, after the Lexus and Ram 1500 pickup turned out to be stolen.

The car wholesaler, 715 Motor Haus, bought a 2021 Dodge Ram 1500 truck for $60,000 in July and a 2018 Lexus GX460 for $43,000 in August, according to a civil lawsuit filed in B.C. Supreme Court.

The seller and defendant in the lawsuit, Samy N R Erian, had “often” sold vehicles to the wholesaler, the claim said.

Erian had told 715 Motor Haus that he was the registered owner of the vehicles but the wholesaler was told in September by the auctioneer at a car auction and by the RCMP that the vehicles had fake VINs and were stolen, the claim said.

The defendant was fraudulent in the sale because he didn’t declare he had clear title, accepted payment without being registered owner and failed to be truthful about the VINs, the claim alleged.

The wholesaler said it suffered loss and damage because of the fraudulent misrepresentations or the negligence of the defendant, and the defendant has been unjustly enriched by the $103,000, the claim alleged.

The wholesaler is seeking return of the $103,000 plus damages, the claim said.

None of the allegations has been proven in court and the defendant has not filed a response.
