Calgary manslaughter suspect Sonya Pasqua’s preliminary inquiry commenced Monday without her present for the hearing into her son’s death.

Justice Karen Molle agreed with Crown prosecutor Shane Parker that Pasqua should be found to have absconded from her preliminary and to have the hearing proceed in her absence.

Pasqua, 33, is charged along with her former partner, Michael Sinclair, 31, with manslaughter in the death of their toddler son, Gabriel Sinclair-Pasqua.

The 18-month-old died Oct. 5, 2021, and the pair were arrested last February after a lengthy police investigation.

Gabriel was discovered in a Radisson Heights residence in the 2800 block of 14 Ave. S.E. Police and EMS responded to reports of the boy in medical distress at 11:20 a.m. He was unresponsive when first responders arrived and was not able to be revived.

He was pronounced dead on scene and a cause of death was not released by the Calgary Police Service.

Molle granted Parker’s application for a warrant for Pasqua’s arrest when she failed to show up in court. After a two-hour delay to see if she could be found court reconvened without her.

Her bail surety told court he had lost touch with the accused.

Parker then asked the Calgary Court of Justice judge to invoke a rarely used section of the Criminal Code which permits preliminary inquiries to proceed in an accused’s absence.

“Our application is that the accused, that being Ms. Pasqua, has absconded,” the prosecutor said.

Pasqua’s lawyer, James McLeod, said Molle could also adjourn the hearing to await for her to attend court.
